What this document records

It is a duplicate of a106

THIS ENTRY AND [A.106] ARE THE SAME DOCUMENT, FROM THE SAME IMAGE FILE. A.106 was created 2026-07-07 and this one 2026-07-12, five days apart, from (archive file) — same Will Book, same pages 54-55, same margin note 113, same unrelated Rachel Cole division on the facing columns. Neither is deleted (IDs never reuse). Each carries something the other lacks: this one gives the volume designation (R-S, 1874-1896) and the [K.58]/[K.59] deed link; A.106 gives the witness relationships. Both now cross-link.

And the duplication goes deeper

THE TWO ENTRIES POINT AT TWO DIFFERENT PERSON FILES FOR ONE WOMAN. [A.106] assigns the testatrix to Elizabeth (Cooper) Gaines Elizabeth Cooper Gaines (b. Mar 1813 - d. 1878); this entry assigns her to RETIRED Elizabeth (Cooper) Gaines (d. 1878, Scott Co., KY). They are the same person — both are the wife of William Gaines, both daughters of Daniel Cooper Daniel Cooper III, both died 1878 in Scott Co., both without issue. The catalog has done this before (John Cooper→John J. Cooper, RETIRED→George Cooper); the merge is recorded as a todo rather than performed here, because two substantial files need reconciling clause by clause.

A will date became a death date

AND THE DUPLICATE CARRIED A FACTUAL ERROR THE ORIGINAL DID NOT. RETIRED recorded death: 1 JAN 1878 — which is the date of this will, not of her death. She was demonstrably alive on 1 January 1878, writing it. [L.4] gives her death as July 1878, and Elizabeth (Cooper) Gaines has it as simply 1878. Corrected on RETIRED 2026-09-01. This is the classic shape of the error: a document's own date is the most conspicuous date on it, and an entry that records a will without recording a death invites the two to be conflated.

What the will actually says

"All the land which I inherited from my father" goes to husband William Gaines for life, then "to such heirs as may be living, of my own relatives" — collaterals, so no issue. The father is not named. That he is Daniel Cooper III is argued from the [K.58] and [K.59] deeds, on the person file.

Transcription and notes

This is the same document as [A.106], catalogued five days later from the same image. Provenance, the duplication (of the entry AND of the person file behind it), and the will-date that was recorded as a death date are all in the source: and coverage: headers and are not repeated here.

Data from the document [verbatim]

"I, Elizabeth Gaines, being of sound mind but in feeble health, desire to make this my last Will and Testament. First, I desire after my death that all the land which I inherited from my father, and all personal property of which I am possessed at the time of my death shall go to my husband William Gaines. The land he is to have the use and benefit of during his natural life. Second, after his death it, the land is to be divided or the proceeds of the sale of said land, and given to such heirs as may be living of my own relatives, any personal property of which I may be possessed at the time of my death I give to my husband Wm Gaines to have and to hold forever. January 1st 1878 Witness: Geo. W. Downing, Jno. R. Hall · [signed] Elizabeth Gaines"
